An Act Proposing an Amendment to the Constitution of the United States of Antarctica Granting the City of Polaris and Its Surrounding Territories a Special Administrative District Status of Autonomy, usually called the Polarian SAD Amendment or Amendment Five, is the fifth Amendment to the Constitution of the United States of Antarctica.
As its name suggests, it created a new political division for Polaris, granting it immense autonomy and greater independence from the reach of the federal government of the United States of Antarctica and mosy of its courts.
The Amendment passed the South Pole Council and was ratified as part of the Constitution on August 2nd, 2011. It was approved by an eighty percent supermajority in a referendum of the effected areas after a week of preparation. Federal oversight cofirmed the election as pure and not rigged.

THE 1337 BILL GRANTING POLARIAN AUTONOMY
AS DRAFTED BY THE PWNSOME SOUTH POLE COUNCIL
MAY 10TH, 2011
AN ACT PROPOSING AN AMENDMENT TO THE CONSTITUTION OF THE UNITED STATES OF ANTARCTICA GRANTING THE CITY OF POLARIS AND ITS SURROUNDING TERRITORIES A SPECIAL ADMINISTRATIVE DISTRICT STATUS OF AUTONOMY
Resolved by the South Pole Grand Krytocratic Council assembled, that the following bill is proposed as an amendment to the Constitution of the United States of Antarctica, which shall be valid to all intents and purposes as part of the Constitution when ratified...
- ARTICLE ONE
§1 The City of Polaris and the Surrounding Communities shall be Ceded and Collected into a new Special Administrative District and shall be granted Greater Autonomy in pursuance to the text of this Amendment herein.
§2 In addition to the City of Polaris, the Surrounding Communities in the new SAD shall be defined as the Municipal Borders of the City of Snowville, the City of Penguville, the City of Enderby City, the Municipality of Harston Lake, The Town of Queensville, the Town of Willis, the Town of Diserster, the City of Worscter, the Town of Lakeland, the Town of Mount Oak, the Town of Deles Reyes, the City of Wicksper, the City of Pertishia, the City of Colline, the City of Arrcraster, the Juno Islands, the Two2 Annex and the Island of Purerto Elanor, and Twenty Miles of Buffer around the Lands Described.
- ARTICLE TWO
§1 The land within the Special Administrative District shall be Granted the Following Privelages and Immunities from the Government of the United States of Antarctica:
- 1) The Jurisdiction of all applicable State Courts of Eastshield, the Happyface State, Trans-Antarctica, and any State-Level Realm that previously held power over the City shall hereby be removed and rendered Void upon Ratification of this Amendment. Polaris may not Enter into Suit on the State Level, nor may State Laws, Precedents, or Judgements be Binding to the City, nor may Polaris be brought to Suit by any State-Level Institution, or any Institution or Creature of Statute which lies below this level.
- 2) The Polarian SAD shall be granted Sovereign Immunity against the United States of Antarctica. Jurisdiction and Prosecution of and by the Federal and Supreme Courts of the United States of Antarctica shall be Limited to Rulings and Regulations Vested in the Grandfathered BORNE and [[HOLINESS] Bureaucries, and strictly in the direct Enforcement of the Constitution of the United States of Antarctica and its Amendments.
- 3) Legislation approved by the South Pole Council shall no longer be Applicable to the Polarian SAD, and all Legislation Currently Affecting the District is hereby rendered Null and Void.
- 4) The Government of the United States of Antarctica may not Legally Prosecute the City of Polaris of any form of Crime or Wrongdoing, unless the SAD Waives its Soverign Immunuity or the Actions Constitute either an Act of War or an Immense Threat to the Security of the Realm. The Government shall also be permitted to Prosecute and Convict Individuals which rest in the Private Sector of the City.
- 5) Pursuant to Article One, the United States of Antarctica Hereby Legitimizes the Polarian City Council and Deems all of its Actions and Processes, regardless of Moral Ambiguity or perceived Dishonesty, Legal and incapable of Interference.
- 6) Pursuant to Article One, the United States of Antarctica may not Interfere or Alter an Election in the District, even if it perceives Fraud or Dishonesty in the System. Non-residents of the SAD may not Intervene in the elections or make Attempts to Curtail or Manipulate the Fraud within. Exemptions contained in this Amendment are not to be counted in this Clause.
- 7) The District shall have the Freedom to Organize and Instate any Form of Government they so By Law Direct, without Exception, nor interference, nor Discretion by the Government of the United States of Antarctica. The District shall be free to Administer Health Services and all other services as it so directs without intervention.
- 8) The District shall not be Compelled to require Receipts to Exceed Outlays, nor to Balance its Budget.
- 9) The District shall not be Bound or Effected by any Institution or Ministry in the Executive Cabinet.
§2 In Pursuance to Autonomy, the United States of Antarctica hereby dissolves:
- 1) All Intelligence and Espionage Operations operated by all Levels of the Realm, and all Police, Fire Prevention, Emergency Response, Nine One One One One, and Defense Institutions currently Protecting the Realm.
- 2) All Federal and State Offices, Headquarters, and Courts operated by all Levels of the Realm. These dissolved institutions shall be immediately Relocated, Reinstated, Resolved, or Terminated as both Courts, the Executive Cabinet, and the Council so direct.
- 3) All manners of Post, but the Postal System shall Continue Servicing the District in accordance with decrees by the Executive Cabinet and by Precedent.
- 4) The Ports of the Standing Armies and Navies of the United States of Antarctica and the Items Within. The Realm shall immediately Withdraw all Militaristic Institutions from the District upon Ratification and Approval of this Amendment.
- 5) All Obligations to Provide for the Common Defense of the District and of the Obligation to prevent Invasion, Insurrection, Rebellion, and Force against the Established Government of the City.
- 6) All Obligations to guarentee any Statutory or Predecental Rights and Liberties which are not Specifically Mentioned in this Constitution.
- 7) All of the District's Delegations to the South Pole Council.
§2 The District shall be Permitted to Raise a Fully Armed and Well-Regulated Militia, constituting no more than One Hundred Thousand Penguins, to Defend the City by Any Means Neccesary. The District shall be Permitted to Operate and Maintain one Deletion Weapon of Mass Destruction, but may not Utilize this Weapon on the United States of Antarctica.
- 1) The District may not Perform any Aggressive or Offensive attacks against the United States of Antartica for Any Reason, nor Declare War on the Realm.
§3 The District shall be Permitted to Re-Establish its own Local Equivalent of all Institutions desolved by this Article.
§4 Members of the City are hereby Disenfranchised from all Elections pertaining to the Rest of the United States of Antarctica, including but in no way limited to South Pole Council Delegations, Judicial Confirmations, and Presidential Elections.
ARTICLE THREE:
§1 To Maintain Integrity between Polaris and the United States of Antarctica, Polaris will remain Bound to Laws, Precedents, Decrees, Orders, Precedents, and other Items wielding the Force of Law produced by the Realm if they can be Categorized as Follows:
- 1) The Item falls under direct Enforcement of this Constitution or any of its Amendments as the Text of the Document so Reads.
- 2) The Item relates to the BORNE or [[HOLINESS] Instituion established previously by the United States of Antarctica.
- 3) The Item relates to enforcing Free Trade and Seamless Passage over the Polarian Two2 Annex or other Insular Waterways falling under the Jurisdiction of the City.
- 4) The Item relates to a Shared Natural Resource or other Feature that falls under the Jurisdiction of both the District and the United States of Antarctica.
- 5) The Item relates to removing the Standing Armies of the Realm, Residing in the District, from the District.
- 6) The United States of Antarctica shall have the Power to Enforce this Article by both Legislation and Executive Actions.
ARTICLE FOUR:
§1 The District shall have the Freedom to Annex Lands and other Realms into its Jurisdiction when Approved by a Seventy Five Percent margin in a Referendum given to both the District and its affected Realm to be Annexed, provided:
- 1) That the Borders of the Annexed Realm be Physically and Visibly Attatched to the District, without Enclave or Exclave status.
- 2) That the Referendum of Annexation be Free, Fair, Untouched, and Pure.
- a) The Federal Government of the United States of Antarctica shall be Permitted to Oversee all Referenda of Annexation and force Recounts, Recalls, and Nullification of the Results, if Corruptuon so Exists.
ARTICLE FIVE:
Marriage in the Special Administrative District, as in all of the United States of Antarctica, shall consist Solely of the Union of One Male and One Female creature of Similar Taxonomy, unless the creature reproduces with only one parent. The regulation of Hetrogamy creatures shall be prescribed in a manner seen fit by the judges and legislatures of the United States of Antarctica, and not the District. Dictoyostelium amoeba conditions vary too as do Rhizopus fungi and similar species, and therefore shall be subject to the regulations and precedents set forth by lawmakers of the United States of Antarctica, and not the District.
Note: The Marriage and Family Act of 2012, which has been approved by a referndum, has altered the definition of marriage within the Federal Republic of Polaris, to state that:
Marriage in the Federal Republic shall consist between two consenting adults, irregardless of gender identity and sexual orientation, but shall remain of similar taxanomy, unless the creature may reproduce with solely one parent.
ARTICLE SIX:
Any and all powers not Specifically Delegated to either the District or the United States of Antarctica are Immediately and Automatically Solely deferred to the District.
ARTICLE SEVEN:
The Courts of the Realm and the Governments of the SAD shall be Empowered to Enforce this Amendment by Appropriate Legislation.
ARTICLE EIGHT:
§1 This Amendment shall be valid to all intents and purposes as part of the Constitution, and binding when ratified per the amending process of the South Pole Council, and then by a Refendum across the effected areas that would become the District. If the Referendum is approved by a fifty percent margin of all citizens in Polaris, the Special Administrative District shall immediately be carved and brought into force and sovereignty.
§2 The Referendum shall be Admnistered, Counted, and Monitored by the United States of Antarctica, not the potential District, to ensure Electoral Purity and Integrity for the populace.
-ENACTED BY THE SOUTH POLE GRAND KRYTOCRATIC LEGISLATIVE COUNCIL, MAY TENTH, IN THE YEAR TWO THOUSAND ELEVEN ANNO DOMINI.
-RATIFIED AS AN AMENDMENT BY THE SOUTH POLE GRAND KRYTOCRATIC LEGISLATIVE COUNCIL, AUGUST SECOND, IN THE YEAR TWO THOUSAND ELEVEN ANNO DOMINI.
-APPROVED BY POPULAR VOTE AND MADE BINDING BY THE CITIZENRY OF POLARIS AND HER OUTLYING AREAS ON AUGUST THIRTEENTH, IN THE YEAR TWO THOUSAND ELEVEN ANNO DOMINI.
OFFICALLY AN AMENDMENT TO THE CONSTITUTION OF THE UNITED STATES OF ANTARCTICA, NOW AND FOREVERMORE. SO BE IT.

Polarian reactions[edit]
The Polaris Independence Day celebrations commenced at 6:55 PM, Polarian Time with a free concert organized by the Polaris City Council. As much as 650,000 penguins attended the event, which had a prodigious outdoor covered stage, in which the artists Katy Spitz, Meaghan and DJ Crow preformed. The stage was set up adjacent to the facade of the Polaris Harborfront Center. The event was organized by the City Planning Committee in mid-2011, when Polarian South Pole Council delegate Diana Dunkin proposed a second SAD Agreement for the City. The City of Polaris doled out 235 million Fish for the event.
Officially known as the Polaris Independence Inauguration, the City of Polaris also inivited a slew of international celebrities, leaders and other distinguished guests. Notable attendees include Emperor Swiss Ninja of Snowzerland, King Carlos Gorbena II of Castilla, Prime Minister Stefan Harplan of Calada, Billy Fence I of Dorkugal, and approximatley 177 other invited guests to the PII celebrations. The entire event was broadcast live on CBN and throughout Eastshield and the rest of Antarctica. The broadcast gained a staggering 28.4 million viewers in Eastshield alone. The Polaris City Council members were seated on the expansive stage, seated in a semicircular Rostrum, divided into three tiers with 100 seats. The Mayors of Penguville, Enderby City, Polaris and Snowville, as well as their deputies, sat at a rectangular table, in front of the rostrum. The municipal politicians where on the topmost tier of the three tiered stage. Many jumbotrons and videoscreens lined the Polaris Promenade, a boulevard leading to the facade of the PHC.
At 12:01:AM, on July 23rd, 2011, the City of Polaris and it's neighbouring municipalities were officially, under the new Polaris Special Administrative District.
International Reactions[edit]
Castilla, being a good ally of Polaris, donated 10,000 Club Penguin Coins to the city for it's promising future. Snowzerland, also being an ally, gave the new Polaris SAD 11,000 Club Penguin Coins, and in addition, Swiss Ninja personally gave Mayor Kratz a life size statue of himself. (His ego never rests, does it?)
